A Dumpster Rental Company
Customer Signature Required Prior to Dumpster Delivery
1. Payment Terms
a. Pricing and Duration
Standard dumpster rentals include the rental period shown at booking, beginning on the delivery date. Prices are confirmed at the time of booking. Extensions beyond the original period must be approved in writing and are billed at the extra-day rate shown at booking, automatically charged to the card on file.
b. Weight Limit and Overage Fees
Each rental includes the disposal weight shown at booking. Weight overages are billed at the overage rate shown at booking, prorated and automatically charged to your card on file. Copies of weight tickets or documentation are available upon request.
c. Other Fees
- Credit card processing fee: 3.65% credit card processing fee added at checkout
- Mileage fee: $3 per mile after 25 miles
- Over-the-rim/top-rail loading fee: $35 over-the-rim fee when applicable
- Credit card dispute: $60 (admin and processor fee)
- Declined credit transaction: $5
- Late fee over 30 days: $35 admin + 16% of invoice total
d. Prohibited Items
The following materials are not allowed in standard dumpster rentals: tires, batteries, wet paint, chemicals, fuel, oil, liquids, biohazard waste, asbestos, concrete, brick, dirt, rock, heavy fill, tree stumps, or any material restricted by the landfill, transfer station, disposal facility, or applicable law.
- Improperly loaded prohibited items, including tires, batteries, or wet paint, may result in a $75 per-item charge plus any required removal or disposal costs
- Materials restricted by the landfill, transfer station, disposal facility, or applicable law must be removed by the customer at their own cost
e. Placement and Responsibility
The customer must choose a suitable delivery site capable of supporting the dumpster's weight and size. FTH Services LLC is not liable for property damage during delivery, placement, or pickup.
- Relocation fee (if moved after delivery): $100
- Unauthorized dumpster movement: $500 penalty + repair costs
- Customer responsible for towing if delivery vehicle becomes stuck
f. Ownership and Damage
Dumpsters remain property of FTH Services LLC. The customer must not damage, overload, or alter the dumpster. Damage caused by misuse or overloading beyond the maximum loaded weight will result in repair charges.
g. Content Ownership
All contents placed inside remain the customer's property until accepted by a landfill or transfer station. FTH Services assumes no responsibility for dumpster contents during transport.
h. Accessibility for Service
The dumpster must be accessible for pickup on the scheduled date. If blocked, a $100 failed pickup fee will apply, plus $15 per day until access is restored.
i. Delivery and Pickup Schedule
Standard service hours: 7 AM–7 PM, Monday–Friday, and 8 AM–5 PM Saturday. Same-day delivery cut-off: 3 PM weekdays / 12 PM Saturday.
2. Dispute Resolution
a. Negotiation and Arbitration
Both parties agree to attempt resolution through good-faith negotiation. If unresolved within 30 days, disputes proceed to arbitration in Monroe County, GA.
b. Legal Proceedings
If arbitration fails, legal action must be filed in Monroe County, Georgia, where both parties consent to jurisdiction.
3. Force Majeure
Neither party is liable for failure to perform obligations caused by events beyond reasonable control — including severe weather, natural disasters, or equipment failure.
4. Limitation of Liability
a. General Liability
FTH Services LLC is not liable for damages or injuries resulting from dumpster use, including property damage due to improper loading or misuse.
b. Indemnity
The customer agrees to indemnify and hold harmless FTH Services LLC from all losses or damages arising from dumpster use.
c. Risk Acknowledgment
By signing this agreement, you acknowledge the risks associated with dumpster use, including injury or property damage, and accept full responsibility.
5. Termination of Agreement
Either party may terminate this agreement in writing. Customers remain responsible for outstanding charges and must ensure the dumpster is accessible for pickup.
6. Privacy Policy
FTH Services LLC collects customer data only to fulfill services and does not share or sell personal information. All bookings must be completed through the online portal to maintain secure processing.
7. Modifications to Terms
These terms can only be changed through a written amendment signed by both parties. Any exception or special disposal arrangement must be confirmed in writing before loading. No verbal agreements or informal changes are binding unless documented by FTH Services.
8. Digital Signature and Acceptance
Electronic signatures and digital acceptance (including checking an agreement box during booking) are legally binding under state and federal law.
